Changes to the New South Wales National Parks & Wildlife

The NSW Parliament in November 1995 passed the National Parks and Wildlife Amendment (Game Bird Protection) Act. This Act prohibited game bird shooting for sporting and recreational purposes and banned open duck seasons.

The National Parks and Wildlife (Game Birds Protection) Act amended the National Parks and Wildlife Act in the following way.

  • Section 95 of the Act was repealed to prevent open seasons from being declared.
  • A definition of game bird was included (game bird means a wild duck, wild goose or wild
    quail, or a bird of any species that the Governor, by order, declares to be a species of game
    bird for the purposes of the Act).
  • Section 70 of the Act was amended to make it an offence to take or kill for sporting or
    recreational purposes game birds within a wildlife district, wildlife refuge, wildlife
    management area, conservation area wilderness area or area subject to a wilderness
    agreement.
  • Section 98 of the Act was amended to make it an offence to take or kill for sporting or
    recreational purposes game birds that are unprotected fauna.
